Restrictions on Parliaments
State parliaments
- Cannot make laws in areas of exclusive powers (e.g. raising military forces, coining money, customs)
- Restricted in area of concurrent power where there is already a federal law – may be void if inconsistent (s109)
- Trade within the Commonwealth must be free (s92)
- Cannot make laws in areas of residual powers (e.g. education, health, roads)
- Freedom of religion (s116)
- Residents of states cannot be discriminated against (s117)
- Acquiring property (s51(xxxi))
- No discrimination in taxation (s51(ii))
